Sellexa hosts listings created by independent sellers. We respect intellectual-property rights and we expect sellers to do the same. This policy explains how we handle reports of alleged infringement under the UK Copyright, Designs and Patents Act 1988, the Trade Marks Act 1994, and related UK law, and how affected sellers can respond.
This policy is part of our Terms of Service and the Seller Agreement.
Sellexa is a marketplace. Independent sellers run their own shops, set their own listings, and are responsible for ensuring they have the rights to the content they post. Sellexa does not pre-screen listings for IP infringement, but we will act on credible reports.
We are not in a position to make final legal determinations of infringement. We will remove or disable access to material that is the subject of a report meeting the requirements in Section 3, in line with our obligations under UK law and our hosting-platform position.
Send a written report by email to our designated IP contact:
Email: ip@sellexa.app
Your report must contain:
We may ask for further evidence (a letter of authorisation from the rightsholder, ID verification, certificate of registration). We may reject reports that are incomplete, abusive, or submitted in bad faith.
If you believe your listing was removed in error, you can file a counter-notice by email to ip@sellexa.app. Your counter-notice must contain:
We forward valid counter-notices to the original reporter. If they do not begin a UK court action against you within 14 days, we may restore the content.
For trade-mark complaints please include your trade-mark registration number and the territory of registration. We will give particular weight to UKIPO and UK-designated EUIPO registrations. Generic or descriptive use, comparative reference, and parody may not constitute infringement; we may decline to remove content where the legal position is unclear and refer the parties to a court.
We terminate selling privileges of users who are subject to repeat or multiple credible IP complaints. We may refuse to onboard a user we believe is operating a new account to evade a previous termination. Termination follows the reasoned-decision and appeal process in the Seller Misconduct & Enforcement Policy.
We accept withdrawals only directly from the rightsholder or their authorised representative who submitted the report. The withdrawal must clearly identify the report and the content covered. We will confirm receipt and notify the affected seller. Withdrawal does not by itself guarantee restoration if there are other unresolved issues with the listing.
